YES Home Privacy Statement

 

The YES Home is dedicated to respecting the privacy of our residents, donors, members, staff, volunteers, and corporate information. YES Home will treat all personal and health information it receives in the course of providing services as confidential and will not disclose or discuss such information with anyone without permission or authorization from YES Home management or as otherwise required by law. YES Home will take care to ensure that unauthorized individuals do not overhear any discussion of confidential information and that documents containing confidential information are not left in the open or inadvertently shared.

OUR USES AND DISCLOSURES

In the course of providing services to you, we may use or share your personal or health information in the following ways.

  • We may use your personal or health information and share it with other professionals who are treating you.

  • We may use and share your personal or health information to provide services to you, coordinate and improve your care, and contact you when necessary.

  • We are allowed or required to share your information in other ways - usually in ways that contribute to the public good, such as public health and research, or as required by State Medicaid and other government agencies. We have to meet many conditions in the law before we can share your information for these purposes.

  • We will share information about you if state or federal law requires it.

  • We may share information about you for certain situations such as:

    • Preventing disease;

    • Reporting suspected abuse, neglect, or domestic violence;

    • Preventing or reducing a serious threat to anyone’s health or safety; and

    • In response to a court or administrative order, or in response to a valid subpoena.

YOUR RIGHTS

This section explains your rights and some of our responsibilities to help.

  • You may ask to see or get a copy of the information we have about you. Ask us how to do this.

  • You may ask us to correct any personal or health information about you that you think is incorrect or incomplete. Ask us how to do this.

  • You may ask us to contact you in a specific way (for example, home or office phone) or to send email to a different address.

  • We will say “yes” to all reasonable requests.

  • If you have given someone medical power of attorney or if someone is your legal guardian, that person can exercise your rights and make YES Home about your health information. We will make sure the person has authority and can act for you before we take any action.

SPECIAL RULES UNDER STATE LAW

Many states have laws that give special protection to certain types of health information such as substance abuse and HIV-related testing and treatment. We generally may not disclose this specially protected information unless you sign a written authorization or a court orders the disclosure. We follow all applicable state and federal laws with regard to your health information.

OUR RESPONSIBILITIES

  • Employees, volunteers, and board members of YES Home may be exposed to information about you which is confidential and/or privileged and proprietary in nature. It is the policy of YES Home that such information must be kept confidential both during and after an individual’s employment or volunteer service. YES Home staff and volunteers, including board members, are expected to return materials containing privileged or confidential information at the time of separation from employment or expiration of service.

  • YES Home will take care to maintain the privacy and security of your personal and health information.

  • Unauthorized disclosure of confidential or privileged information is a serious violation of YES Home policy and will subject the person(s) who made the unauthorized disclosure to appropriate discipline, including removal/dismissal.
